RISK OF LOSS

All items purchased from Tiny Togs are made pursuant to a shipment contract. This basically means that the risk of loss and title for such items pass to you upon our delivery to the carrier.

All prices are inclusive of V.A.T at the prevailing rate where applicable.

PRODUCT DESCRIPTIONS

Tiny Togs and its associates attempt to be as accurate as possible. However, Tiny Togs does not warrant that product descriptions or other content of this site is accurate, complete, reliable, current, or error-free. If a product offered by Tiny Togs itself is not as described, your sole remedy is to return it in unused condition.

APPLICABLE LAW

By visiting Tiny Togs, you agree that the laws of Ireland, without regard to principles of conflict of laws, will govern these Conditions of Use and any dispute of any sort that might arise between you and Tiny Togs or its associates.

DISPUTES

Any dispute relating in any way to your visit to www.Tiny Togs.ie or to products you purchase through Tiny Togs shall be submitted to confidential arbitration in Ireland, except that, to the extent you have in any manner violated or threatened to violate Tiny Togs intellectual property rights, Tiny Togs may seek injunctive or other appropriate relief in any court in Ireland (under Irish law), and you consent to exclusive jurisdiction and venue in such courts. Arbitration under this agreement shall be conducted under the rules then prevailing of the American Arbitration Association or European / British equivalent. The arbitrators award shall be binding and may be entered as a judgment in any court of competent jurisdiction. To the fullest extent permitted by applicable law, no arbitration under this Agreement shall be joined to an arbitration involving any other party subject to this Agreement, whether through class arbitration proceedings or otherwise.

SITE POLICIES, MODIFICATION, AND SEVERABILITY

Please review our other policies, such as our Shipping and Returns policy, posted on this site. These policies also govern your visit to www.TinyTogs.ie. We reserve the right to make changes to our site, policies, and these Conditions of Use at any time. If any of these conditions shall be deemed invalid, void, or for any reason unenforceable, that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition.

RETURNS POLICY

Items must be returned within 14 days of receipt for exchange or refund to our Office address.  This will be provided once you request a return.

Items must be in original, saleable condition - with all hangers, labels and wrappings in their original condition.

Kindly return the item to us via post (enclosing your invoice) to the address shown on your invoice.  We recommend you obtain a receipt from the post office or better to send by registered post.

Return postage costs incurred by the customer are not refundable.

Exchanges/refunds will be issued AFTER item has been returned and subject to satisfactory inspection. Standard Refunds (ie none faulty) will be cost of item less postage & packaging costs – which are included in the sale price of our products. Returns will be processed within 7 working days.

Faults

We do not experience many faults, but if you believe you have a faulty product we would ask you to return it to us within a reasonable period of time (using the returns form on your invoice) and kindly return the item to us via 2nd class post (enclosing your invoice) to the address shown on your invoice.

When we receive the faulty item we shall reimburse the return postage (please note we only reimburse the cost of 2nd class postage) and send you a replacement item.

If you no longer have your invoice then please enclose a covering letter explaining your reason for return.  We will then contact you via email/telephone (your choice) to confirm receipt and advise if we believe that the goods are in fact faulty.  If the goods are deemed to be faulty, we shall issue a replacement and cover return postage costs.

Incorrect Items

We do not experience any problems, but if you believe you have an incorrect item, we would ask you to return it to us within a reasonable period of time (using the returns form on our website) and kindly return the item to us via post (enclosing your invoice) to the address shown on your invoice.

When we receive the item we shall reimburse the return postage (please note we only reimburse the cost of standard postage) and send you a replacement item.

Items Returned

Parcels returned back to us marked as 'not called for' by An Post are subject to the applicable shipping costs charge to be re-posted or refunded.

Non-deliveries MUST be reported within 21 days from receiving your dispatch confirmation email.
